Encompass Care Services Ltd | Last updated: October 13, 2026

Introduction

These Terms of Service ("Terms") are a binding agreement between you ("you", "user") and Encompass Care Services Ltd, a private limited company registered in England and Wales under company number 13960372 (incorporated on 7 March 2022, registered office: 307 Euston Road, London, NW1 3AD, United Kingdom) ("Company", "we", "us").

The Terms govern your use of the browser game FarmCoast and the websites farmcoast.fun and play.farmcoast.fun, together with all related accounts, payment flows, in-game features, digital content, and support services (the "Platform").

By creating an account, playing the game, or purchasing digital content, you confirm that you have read and accepted these Terms. If you do not accept them, do not use the Platform.

1. Definitions

(a) "Gold" — the in-game currency earned through gameplay (harvesting, production, trading with in-game merchants). Gold cannot be purchased for real money and cannot be withdrawn or converted into real money.

(b) "Gems" — the premium balance of the Platform. Gems may be purchased for real money, may be earned through gameplay (including by selling rare crops at the in-game Player Market) or granted through promotions, and may be spent on Platform features such as restoring energy, speeding up timers, and obtaining rare items. All Gems are treated the same regardless of how they were obtained. Gems cannot be withdrawn, exchanged, or converted into real money.

(c) "Gem Purchase Rate" — the rate at which Gems are sold by the Company. Unless otherwise displayed at checkout, the Gem Purchase Rate is 1 Gem = 0.10 EUR.

(d) "Virtual Items" — any in-game content: buildings, crops, animals, tools, machines, resources, decorations, paths, consumables, cosmetics, and other in-game objects or entitlements.

(e) "Digital Content" — Virtual Items, Gold, Gems, and any other digital material supplied through the Platform.

(f) "Consumer" — a natural person acting outside their trade, business, or profession.

(g) "Commission" — any fee retained by the Company on a purchase or other transaction, as displayed on the Platform or described in these Terms.

(h) "Services" — the game, the website, accounts, purchases, support, and all related services provided by the Company.

3. Our Services

FarmCoast is a browser-based 2D farming game set on a tropical coast. The game includes growing crops in sand and soil, fishing, raising animals, production chains, resource gathering, tool crafting and repair, quests, building a boat, an in-game market with a computer-controlled trader, a Player Market where rare crops are sold for Gems, and the virtual currencies Gold and Gems.

All rights in the game and the Platform — software, artwork, design, characters, texts, game systems, databases, and trademarks — belong to the Company or its licensors. Using the Services does not transfer ownership of the game, any Virtual Item, or any balance to you.

Provided you comply with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for personal entertainment.

As a live game in active development, we may add, change, rebalance, restrict, or remove features, items, currencies, prices in virtual currency, drop rates, and other elements of the Services, subject to applicable consumer law.

4. Eligibility and Age Requirement

The Platform is intended only for users who are at least 18 years old. By using the Platform you confirm that you are 18 or older and have the legal capacity to enter into this agreement.

You may not use the Platform where doing so is unlawful in your jurisdiction. We may restrict access in countries or territories where operating the Platform would be prohibited or would require licences or compliance measures we do not maintain, and we may use geolocation, payment screening, and verification tools to enforce this.

5. Account Registration and Security

An account is required to play. You agree to provide accurate information at registration and keep it up to date.

You are responsible for the confidentiality of your credentials and for all activity under your account. Accounts are personal: you may not share, sell, rent, or transfer your account. Notify us immediately at support@farmcoast.fun if you suspect unauthorised access.

We may restrict or suspend an account we reasonably believe is compromised or involved in fraud, abuse, chargeback misuse, automation, or other breaches of these Terms.

6. Virtual Items and Digital Content

Virtual Items and Digital Content are licensed for use within the Platform, not sold to you as property. You acquire no ownership, property, or intellectual-property rights in them and no right to use them outside the Platform.

Virtual Items may be obtained through gameplay, purchases, quests, or promotions. Their availability, characteristics, and prices in virtual currency may change over time as part of game development and balancing.

Virtual Items, Gold, and Gems may not be sold, traded, gifted, or transferred outside the Platform. Off-Platform transactions are prohibited and may lead to suspension and forfeiture of the content involved.

7. Gold

Gold is earned through gameplay and spent only within the game (for example, at the in-game market or on construction).

Gold has no monetary value. It is not legal tender, not electronic money, not a financial instrument, and cannot be purchased for, redeemed for, or converted into real money. Gold is not subject to refund.

8. Gems

Gems are the premium balance of the Platform. Gems may be purchased in-game via Menu → My Profile → Wallet → Buy Gems, at the prices displayed on the purchase screen, and may also be granted through gameplay or promotions.

Gems may be spent within the game — including on restoring energy, speeding up construction and production timers, and obtaining rare items. Once Gems are spent or otherwise consumed, they are treated as consumed Digital Content and are not refundable except where the law requires otherwise.

Gems are a virtual in-game currency used to speed up gameplay and unlock in-game features. You can play FarmCoast at its normal pace without buying Gems, or use Gems to speed things up. Gems can be purchased in-game or earned through gameplay, including by selling rare crops at the in-game Player Market. All Gems are treated the same regardless of how they were obtained. Gems are not legal tender, not a deposit, not electronic money, and not a security or investment product, and carry no right to interest or appreciation. Gems cannot be withdrawn, sold, exchanged, or converted into real money or any other value outside the Platform, and the Company offers no payout, cash-out, or reverse-conversion function. The Platform does not guarantee any particular financial outcome from playing.

Gems connected to fraud, chargebacks, technical errors, promotional grants, or suspected unlawful conduct may be frozen, reversed, or removed.

If you purchase Gems and request immediate delivery, you acknowledge that you may lose your statutory right to cancel once delivery begins (see Section 16).

9. In-Game Market and Player Market

The in-game market allows you to buy and sell Virtual Items and resources for Gold with a computer-controlled trader. This market operates entirely inside the game and involves no real money.

Rare crops designated by the game may also be sold at the in-game Player Market for Gems. Gems received from such sales are credited to your account by the Platform and are subject to Section 8: they may be spent within the game and cannot be converted into real money.

The in-game market is not an exchange, a financial market, a payment service, or a gambling service. Prices at the in-game market and the Player Market are part of game balance and may change.

10. Payments and Pricing

Prices are displayed at checkout in the applicable currency and include taxes where the law requires. Payments are processed by authorised third-party payment providers; by submitting payment details you authorise the applicable charge.

We do not store full card details; payment data is handled by the payment provider under its own terms and privacy notice.

We may refuse, cancel, or reverse a transaction in cases of pricing or technical error, suspected fraud, chargeback risk, compliance concerns, or breach of these Terms.

11. Commissions and Fees

The Platform may charge Commissions or fees on purchases or other transactions. Where a Commission applies, its amount or calculation method will be shown in the relevant flow or in these Terms; confirming the transaction constitutes acceptance of the Commission.

We may update Commissions and fees from time to time. Changes do not affect transactions already completed, except where required by law, payment rules, or fraud handling.

12. Compliance and Sanctions

We may perform payment verification, sanctions screening, transaction monitoring, and other checks required or permitted by law, payment-provider rules, or our risk controls.

You agree to cooperate with reasonable verification requests; failure to do so may result in transaction limits or account restrictions. You confirm that all funds you use on the Platform come from lawful sources and that your use of the Platform complies with applicable law, including sanctions rules. We may report suspicious activity to competent authorities where required or permitted by law.

13. Acceptable Use

You must not:

(a) use bots, scripts, macros, or other automation to play or gain advantage; (b) exploit bugs, balancing errors, or payment errors instead of reporting them to support@farmcoast.fun; (c) manipulate game systems, rewards, or the Player Market; (d) create or use multiple accounts to abuse promotions, bypass limits, or conceal identity; (e) buy, sell, rent, or trade accounts, Gold, Gems, or Virtual Items outside the Platform; (f) harass or threaten other users or submit unlawful, hateful, or fraudulent content; (g) use the Platform for gambling, sanctions evasion, or any other unlawful value transfer; (h) reverse-engineer, copy, or interfere with the Platform or the game; (i) use stolen or unauthorised payment methods, or enter card details that you are not authorised to use; (j) attempt to bypass security, verification, regional, or account controls.

14. Suspension, Termination, and Forfeiture

We may restrict, suspend, or terminate your account or access to features if we reasonably believe you have breached these Terms, violated the law, abused game or payment systems, caused chargebacks, or otherwise harmed the Platform or other users.

Upon suspension or termination we may, subject to applicable law, freeze or forfeit Virtual Items, Gold, Gems, and other account features connected to the breach.

You may request closure of your account at support@farmcoast.fun. Closure may be delayed while there are pending transactions, disputes, verification obligations, or legal retention requirements.

15. Delivery of Digital Content

Digital Content is normally credited to your account immediately after payment confirmation, or within a short technical processing period.

If purchased content is not delivered, contact support@farmcoast.fun — we will investigate and deliver the content, correct the balance, or refund you where the law or the Refund Policy requires.

16. Refunds and Consumer Right to Cancel

Refunds are governed by this Section and the Refund Policy published on the Platform.

If you are a Consumer in the United Kingdom or the EU/EEA, you normally have a 14-day right to cancel (withdraw from) a distance contract. For Digital Content, this right is lost where you expressly request immediate delivery and acknowledge the loss of the right to cancel; the checkout flow will ask for this consent so that Gems and other content can be delivered immediately.

Gems and other Digital Content that have been delivered and then spent, consumed, used in gameplay, or otherwise activated are not refundable except where required by applicable law. Entirely unused Gem purchases may be refunded as described in the Refund Policy.

17. Intellectual Property

All intellectual property in the Platform and the game — code, artwork, animations, design, texts, characters, items, sounds, databases, balancing, names, and logos — belongs to the Company or its licensors.

You may not copy, modify, distribute, sell, publish, create derivative works from, scrape, or commercially exploit any part of the Platform without our prior written consent, except where mandatory law allows.

18. User Content

Where the Platform lets you submit content (for example a nickname, profile content, or support messages), you grant us a worldwide, non-exclusive, royalty-free licence to host, display, process, moderate, and remove that content as needed to operate and protect the Platform.

You must not submit content that is unlawful, infringing, abusive, misleading, or otherwise harmful.

19. Third-Party Services

The Platform relies on third-party services such as payment processing, hosting, and email delivery, and may contain links to third-party sites. We are not responsible for services we do not control; your use of them is subject to their own terms and privacy notices.

20. Availability and Changes to the Game

The game is provided as a live service in active development. Features may be added, changed, or removed, and maintenance windows may occur. If we permanently discontinue the game, we will give reasonable advance notice on the Platform.

21. Disclaimers

The Platform and Services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, compatibility with every device, or availability in every jurisdiction.

We do not guarantee any gameplay outcome, item availability, Gem value, or any financial result. Nothing on the Platform is financial, tax, legal, or other professional advice.

22. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability in connection with the Platform and these Terms is limited to the greater of (i) the amount you paid us in the 12 months before the event giving rise to the claim, or (ii) EUR 100.

To the same extent, we are not liable for indirect, incidental, consequential, or special damages, including loss of data, goodwill, or opportunity, or losses arising from gameplay outcomes, account suspension, or third-party services.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protections.

23. Indemnification

To the extent permitted by law, you agree to indemnify the Company and its officers, employees, contractors, and licensors against claims, losses, and costs arising from your breach of these Terms, unlawful conduct, infringement of third-party rights, payment misuse, or chargebacks caused by your breach.

24. Changes to These Terms

We may update these Terms. For material changes we will take reasonable steps to notify you through the Platform or by email before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Platform and you may request account closure.

25. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without prejudice to mandatory consumer protections of your country of residence.

Before starting formal proceedings, both parties agree to attempt to resolve the dispute informally by contacting support@farmcoast.fun. We are not obliged to, and do not currently, take part in any alternative dispute resolution scheme. Consumers in the United Kingdom may seek free advice from Citizens Advice (https://www.citizensadvice.org.uk), and Consumers in the EU/EEA may contact the consumer dispute resolution bodies of their country of residence. Disputes that cannot be resolved otherwise are subject to the jurisdiction of the courts of England and Wales, unless mandatory law provides otherwise; in particular, Consumers may be entitled to bring proceedings in the courts of their country of residence.

26. General Provisions

(a) Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Refund Policy, and any additional rules published on the Platform, form the entire agreement between you and the Company regarding the Platform. (b) Severability. If any provision is found invalid, the remaining provisions stay in force. (c) No waiver. Not enforcing a provision does not waive our right to enforce it later. (d) Assignment. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a merger, acquisition, or sale of business. (e) Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including network or payment-provider failures, cyber incidents, governmental actions, or natural disasters. (f) Language. These Terms are drawn up in English; if translated, the English version prevails unless mandatory law provides otherwise.
